Agreement to Terms
By accessing, browsing, or logging into DiversionIQ's services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. Your continued use of the service constitutes acceptance of these terms. If you do not agree to these terms, you must immediately discontinue use of the service.
About DiversionIQ
DiversionIQ is a product and subsidiary of PJL Telecom LLC, a Colorado limited liability company. References to "DiversionIQ," "we," "us," or "our" in these terms include PJL Telecom LLC and its affiliates.
Description of Service
DiversionIQ provides real-time flight diversion monitoring and alerting services for airport operations teams. Our service monitors flight data from industry-standard aviation data sources to detect and track aircraft diversions.
Account Registration
To use our services, you must create an account and provide accurate, complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
Subscription and Payment
DiversionIQ offers subscription-based services. By subscribing, you agree to:
- Pay all fees associated with your selected plan
- Automatic renewal unless cancelled before the billing cycle
- Our refund policy as stated in your subscription agreement
Free Trial
Certain plans may include a free trial period. At the end of the trial, your subscription will begin unless you cancel. No credit card is required for trial-eligible plans during the trial period.
Acceptable Use Policy
You agree to use DiversionIQ only for lawful purposes and in accordance with these terms. The following activities are strictly prohibited:
Account & Access
- Sharing account credentials with unauthorized users or exceeding your plan's user limits
- Attempting to gain unauthorized access to our systems, networks, or other user accounts
- Circumventing or attempting to circumvent access controls, authentication, or security measures
- Using the service from more devices or locations than permitted by your subscription tier
Data Usage & Redistribution
- Redistributing, reselling, sublicensing, or commercially exploiting DiversionIQ data without prior written consent
- Using DiversionIQ data to create, enhance, or operate a competing product or service
- Aggregating DiversionIQ data with other sources to create derivative datasets for sale or distribution
- Presenting DiversionIQ data as your own proprietary information without attribution
- Using the data for any purpose other than your organization's internal operational needs
Technical Restrictions
- Using automated systems, bots, scrapers, or similar tools to extract data from the service (except through authorized API access)
- Reverse engineering, decompiling, or attempting to derive the source code of the service
- Interfering with or disrupting the service, servers, or networks connected to the service
- Introducing malware, viruses, or other harmful code
- Exceeding API rate limits or using the API in a manner that degrades service for other users
Display & Attribution
- If displaying DiversionIQ data on signage or internal systems, you must not remove or obscure any disclaimers or attribution
- You may not represent DiversionIQ data as official government or FAA information
- Public display of DiversionIQ data outside your organization requires prior written approval
API Access (Enterprise)
- API access is granted solely for integration with your organization's internal systems
- API credentials are confidential and may not be shared or embedded in client-side code
- You must implement reasonable caching to minimize redundant API calls
- DiversionIQ reserves the right to throttle or suspend API access for excessive usage or abuse
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.
Data Accuracy Disclaimer
While we strive to provide accurate and timely flight diversion information, DiversionIQ does not guarantee the accuracy, completeness, or timeliness of the data. Flight information is provided for informational purposes only and should not be the sole basis for operational decisions.
Third-Party Data Sources
DiversionIQ sources the majority of its flight data through proprietary methods and direct industry feeds. In certain cases, we may supplement this data with information from third-party data networks to enhance coverage and accuracy. We are not responsible for errors, omissions, delays, or inaccuracies originating from third-party data sources, and we make no representations or warranties regarding such data.
Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. DIVERSIONIQ DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
Intellectual Property
The service and its original content, features, and functionality are owned by DiversionIQ and are protected by international copyright, trademark, and other intellectual property laws.
Limitation of Liability
To the fullest extent permitted by law, DiversionIQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to:
- Loss of profits, data, or business opportunities
- Service interruptions or data inaccuracies
- Actions taken based on information provided by the service
Indemnification
You agree to indemnify and hold harmless DiversionIQ and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the service or violation of these terms.
Modifications to Service
We reserve the right to modify, suspend, or discontinue any aspect of our service at any time. We will provide reasonable notice of any material changes.
Termination
We may terminate or suspend your account at any time for violations of these terms. Upon termination, your right to use the service will immediately cease. You may cancel your subscription at any time through your account settings.
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of law principles.
Dispute Resolution
Any disputes arising from these terms or your use of the service shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be resolved exclusively in the state or federal courts located in the State of Colorado, and you consent to the personal jurisdiction of such courts.
Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against DiversionIQ. If this waiver is found to be unenforceable, then the entirety of this dispute resolution section shall be null and void.
Force Majeure
DiversionIQ shall not be liable for any failure or delay in performing its obligations under these terms due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government actions, power outages, internet or telecommunications failures, or failures of third-party data providers.
